Access: The service is currently provided free of charge with optional user accounts for enhanced features. We reserve the right to introduce paid tiers or modify service access in the future with reasonable notice.

AI-Generated Summaries: Summaries generated by our AI system are provided to you under a non-exclusive license for your personal or commercial use. We reserve the right to use anonymized or aggregated summary data to improve our AI models and services.

Third-Party Content: Content summarized from YouTube may include third-party copyrighted material. You are responsible for obtaining appropriate permissions if you republish or redistribute summaries. YouTube's terms of service continue to apply to underlying video content.

Platform Content: All content on the TooLong.XYZ platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of TooLong.XYZ or its licensors and is protected by copyright and intellectual property laws.

9. AI-SPECIFIC TERMS

YouTube Data Usage: Data obtained from YouTube (including video metadata, transcripts, and captions) is used solely to provide our summarization service. We do not use YouTube data to train, improve, or develop AI/ML models. YouTube data is processed only for generating summaries and complies with YouTube's Terms of Service and API Services Terms.

AI Limitations: Our AI system is not infallible and may fail to capture important nuances, context, or details from original content. The system may:

• Generate summaries that reflect biases present in training data
• Fail with unusual content formats, multiple languages, or highly technical material
• Produce incomplete or misleading interpretations

No Sensitive Information: The AI system is not designed to handle sensitive personal information. Users should not input personal data, confidential information, or sensitive material into the system.

10. ACCEPTABLE USE POLICY

You agree not to:

Fair Use: All users must comply with fair use guidelines:

• Do not use bots, scripts, or automated tools to generate excessive requests
• Do not resell or redistribute summaries generated by our service
• Do not use the service to circumvent rate limits through multiple accounts
• Do not use the service in a manner that degrades performance for other users

Enforcement: We reserve the right to monitor usage patterns and take action against accounts that violate fair use policies, including:

• Temporary or permanent account suspension
• Rate limiting or throttling of service access
• Termination of paid subscriptions without refund
• Legal action for severe violations

Users will typically receive one warning before enforcement action is taken, except in cases of severe abuse or automated attacks where immediate suspension may occur.

12. DISCLAIMERS OF WARRANTIES

AS-IS SERVICE: THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR COMPLETENESS.

We make no representation regarding:

• The accuracy, completeness, or reliability of AI-generated summaries
• Uninterrupted or error-free service operation
• The security of data transmission over the Internet
• The legality or propriety of third-party content that may appear in source materials
• Compatibility with all devices, browsers, or operating systems

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY SINGAPORE LAW, IN NO EVENT SHALL TOOLONG.XYZ, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or cost of substitute services
• Damages arising from inaccurate summaries, service interruptions, or data loss

LIABILITY CAP: Our total aggregate liability for all claims arising from this agreement shall not exceed SGD $100 or the amount paid by you in the 12 months preceding the claim, whichever is greater.

Exceptions: This limitation does not apply to liability for data breaches caused by our gross negligence, willful misconduct, personal injury, death, or liability that cannot be excluded by Singapore law.

14. ACCOUNT TERMINATION AND SUSPENSION

Termination by You: You may terminate your account at any time by contacting us at hello@toolong.xyz. Upon termination, your right to use the service will immediately cease.

Termination by Us: We reserve the right to suspend or terminate your access to the service, with or without notice, for:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons

Effect of Termination: Upon termination, we will delete or anonymize your personal data in accordance with our Privacy Policy and data retention obligations under Singapore law.

14. DISPUTE RESOLUTION

Good Faith Negotiation: Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good faith negotiation for a period of 30 days.

Jurisdiction: If negotiation fails, any disputes arising from or relating to these Terms shall be resolved exclusively in the courts of Singapore. You irrevocably submit to the exclusive jurisdiction of the Singapore courts and waive any objection to venue.

Limitation Period: Any claim or action arising from this agreement must be filed within two (2) years of the date the cause of action arose, or such claim shall be permanently barred.

15. GENERAL PROVISIONS

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TooLong.XYZ regarding the use of our service.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
